End User License Agreement

License grant

Subject to this EULA, Betadwarf grants you a personal, limited, non-exclusive, non-transferable and non-sublicensable license to install, access and use the Software for your personal, non-commercial entertainment.

License, not sale

The Software is licensed, not sold. No ownership rights in the Software are transferred to you under this EULA.

System requirements

You are responsible for ensuring that your hardware, operating system, internet connection and any other equipment or software meet the minimum system requirements for the Software as published by Betadwarf or the applicable Platform from time to time. Betadwarf is not responsible for any inability to use the Software resulting from your failure to meet those requirements.

Minimum age

You must, at a minimum, be 13 years of age, or such higher minimum age of digital consent as may be required under the laws applicable in your country of residence, to install, access or use the Software on your own behalf.

Parental consent

If you are below the applicable minimum age, a parent or legal guardian must review and agree to this EULA on your behalf, and is responsible for your use of the Software, including any purchases made in connection with it.

Additionally, separate age restrictions may apply to certain purchases available in connection with the Software, including in-game purchases, where the applicable national or local legal age requirement is higher than the minimum age set out above. If you do not meet the applicable minimum legal age for a given purchase, you must not make that purchase, and any such purchase made by you must be authorised by a parent or legal guardian who meets that age requirement.

The Software may include marketing and promotional content. Marketing communications and in-Software promotional content are intended to be suitable for the age group corresponding to the age rating of the relevant Software.

Ownership

Betadwarf and its licensors retain all rights, title and interest in and to the Software and associated Services and content.

This includes, where applicable, software, source and object code, characters, names, artwork, graphics, animations, music, audio, dialogue, stories, worlds, designs, gameplay systems, databases, trademarks and other intellectual properties.

Reservation of rights

We may modify, update, suspend or discontinue features or Services where reasonably necessary for development, technical, security, legal or operational reasons.

Updates

We may provide patches, updates, fixes, balancing changes, modifications, additional content or other changes to the Software from time to time.

Updates may be downloaded and installed automatically by the Platform through which you access the Software.

Required updates

Some updates may be required in order to continue using some or all of the Software, particularly online functionality.

The Software and its features may evolve over time as part of ongoing development and operation.

Internet and online services

Some Software may require an internet connection or access to online services.

Online functionality may depend on services operated by Betadwarf or third parties and may occasionally be unavailable due to maintenance, updates, technical issues or other circumstances.

The Software may collect technical data, such as crash reports, device information, performance metrics and gameplay data, for the purposes of operating, maintaining, improving and securing the Software. Further details about the data we collect and how we process it are set out in our Privacy Policy.

Changes to online functionality

We may modify, suspend or discontinue online functionality where reasonably necessary for technical, operational, security, legal or development reasons.

Account responsibility

Certain Software or Services may require you to create or use a player account, whether managed by us or by a Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Suspension

We may suspend or restrict access to an account where we reasonably believe it has been used fraudulently, shared or transferred in an unauthorized manner, or used in a way that violates this EULA.

Platform terms

The Software may be distributed or made available through third-party platforms, including Steam, Xbox, PlayStation, Google Play and Apple's App Store (each, a "Platform").

Conflicting terms

If a mandatory Platform term conflicts with this EULA, the applicable mandatory Platform term will apply to the extent of that conflict. Betadwarf is not responsible for a Platform's own acts, omissions, availability, security, content moderation or terms, and does not guarantee the accuracy or completeness of information a Platform provides.

Digital items and currencies

The Software may provide access to digital content, such as virtual currencies, items, characters, cosmetics, rewards or other similar content.

Such digital content forms part of the Software or associated Services and, unless otherwise required by applicable law, is licensed to you rather than sold.

No real-world ownership

Digital content does not represent real-world money or property and may only be used or transferred as expressly permitted within the applicable Software or Service.

Purchases of digital content, including in-game purchases and any other purchases connected to the Software, can only be made through third-party Platforms and not through Betadwarf directly. Such purchases are subject to the relevant Platform's applicable purchasing, payment and refund terms.

Sharing gameplay

We support players sharing their experiences with our Software.

Subject to this EULA and our Terms of Use, you may capture, stream and share gameplay footage, screenshots and other content from the Software for personal and community purposes, including through streaming, video and social-media services.

Intellectual property and third-party content

This permission does not transfer ownership of Betadwarf intellectual property and does not permit use of our content in a way that falsely suggests endorsement by Betadwarf or is otherwise unlawful.

Third-party music, trademarks or other licensed material contained in the Software may be subject to separate restrictions.

Player-created content

Some Software may allow you to create custom content such as mods, maps, decks, cards or other user-generated content (“UGC”). You retain ownership of the original elements you create, but any Betadwarf intellectual property incorporated into your UGC remains owned by Betadwarf.

License to Betadwarf

By creating, uploading or sharing UGC in connection with the Software, you grant Betadwarf a worldwide, royalty-free, non-exclusive, sublicensable license to use, host, reproduce, adapt and display that UGC in connection with operating, supporting and promoting the Software. This license includes the right to sublicense to our service providers and third-party Platforms to the extent reasonably necessary for those purposes. Upon termination of this EULA, this license will terminate, except that it will continue to apply to UGC that is technically integrated into the Software or a Service and cannot reasonably be separated, and to UGC already included in published promotional or community materials. Betadwarf will not use UGC to develop, train, fine-tune or improve a general-purpose artificial intelligence or machine-learning model unless Betadwarf obtains your separate, informed consent for a specific feature.

Restrictions

UGC must not infringe the rights of any third party, contain unlawful, hateful or infringing content, or be used as a means to circumvent the restrictions in Section 4 (License Restrictions).

Term

This EULA remains in effect until terminated by you or Betadwarf.

Termination by you

You may terminate it at any time by ceasing use of and uninstalling the Software.

Termination by Betadwarf

Betadwarf may terminate or restrict the license granted under this EULA where reasonably necessary as a result of a material or repeated breach of this EULA or our Terms of Use, unlawful activity, cheating, security concerns, risks to other players or the Software, or where we permanently discontinue the relevant Software or Service.

Third-party beneficiaries

Where the Software or a related Service is published, distributed or operated in whole or in part by or on behalf of a third-party publisher or operator engaged by Betadwarf (a "Publisher"), that Publisher is an intended third-party beneficiary of Sections 4 (License Restrictions), 7 (Accounts), 12 (Termination), 13 (Disclaimer and Liability) and 14 (Governing Law and Disputes) of this EULA, to the extent those provisions relate to the Software or Service that the Publisher publishes, distributes or operates. References to "we", "us" or "our" in those provisions include the relevant Publisher, solely for the purpose of allowing the Publisher to rely on, and be protected by, those provisions. A Publisher may not independently enforce any remedy under those provisions (including termination or restriction of your license under this Section 12) without Betadwarf's prior written approval. This does not make the Publisher a party to this EULA, and Betadwarf remains the sole party contracting with you under this EULA.

Effect of termination

Upon termination of your license, you must cease using the Software to the extent required by the termination.

Discontinuation of the Software

If we permanently discontinue the Software or a material part of it, we will, where reasonably possible and to the extent required by applicable law, provide reasonable advance notice and describe what will happen to any related virtual currencies, items or progression. Nothing in this Section 12.6 limits any refund or remedy right you may have under applicable law or applicable Platform refund policies in connection with a discontinuation.

Software availability

The Software is provided with the level of care required by applicable law.

Consumer rights

Nothing in this EULA excludes, restricts or modifies any warranty, remedy, liability or consumer right that cannot lawfully be excluded, restricted or modified.

Limitation of liability

To the maximum extent permitted by applicable law, Betadwarf will not be liable for indirect or consequential losses arising from use of the Software, or for loss or damage caused by a third party, including a Platform or other user of the Software, or for loss or damage that you could reasonably have avoided or mitigated. Nothing in this Section 13.3 limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

Severability

If any provision of this EULA is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Entire agreement

This EULA, together with our Terms of Use, our Privacy Policy, and any applicable Platform terms, constitutes the entire agreement between you and Betadwarf regarding the Software and supersedes any prior agreements on that subject. Additional policies or guidelines referenced in this EULA or published on our website (for example, community guidelines) form part of this agreement to the extent they are expressly incorporated by reference.

No waiver

Our failure to enforce any provision of this EULA is not a waiver of our right to enforce that or any other provision on a future occasion.

Assignment

We may assign or transfer this EULA, including in connection with a merger, acquisition, restructuring or sale of assets, provided that the assignee assumes all of Betadwarf's obligations under this EULA. If such an assignment materially and adversely affects your rights under this EULA, you may terminate your use of the affected Software by providing written notice within thirty (30) days of the date on which we notify you of the assignment. You may not assign or transfer your rights under this EULA without our prior written consent.

Export control and sanctions

You agree to comply with all applicable export-control and economic-sanctions laws and regulations in connection with your use of the Software, including EU sanctions regulations, US sanctions administered by the Office of Foreign Assets Control (OFAC), and Danish national sanctions measures. You represent that you are not located in, or ordinarily resident in, a country or territory that is the target of comprehensive sanctions, and that you are not designated on any applicable restricted-party list.

Force majeure

We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including outages, natural events, or acts of government.

Feedback

If you choose to send us ideas, suggestions or other feedback about the Software through our designated feedback or support channels, you grant Betadwarf a perpetual, irrevocable, worldwide, royalty-free licence to use, modify, sublicence and otherwise act on that feedback for any purpose, without any obligation to compensate or credit you.
